Your privacy is important to us, and this privacy policy describes how we process personal information as part of our business operations, including the types of personal information we collect, the purposes for which we use it, the types of third parties with whom we share it, and the rights and responsibilities you may have with respect to such personal information. This privacy policy applies to the personal information you provide to us through any type of engagement or interaction, such as when you use our website at zubrconstruction.com (the “Site”) and the online services therein. By accessing or using the Site or otherwise providing us with personal information, you consent and agree to the terms and conditions set forth in this privacy policy.

  • Business contact data, such as information related to employees, owners, directors, officers, or contractors of a third-party organization (e.g., a supplier, subcontractor, or business partner) with whom ZUBR may conduct, or possibly conduct, business.
  • Marketing and communications data, including your marketing preferences and subscriptions to our publications, newsletters, or marketing materials.
  • Your feedback and comments, including comments or statements you provide to us through the Site.

When you do not provide personal information that ZUBR requests, we may not be able to provide you the requested service or complete a transaction, and you agree that ZUBR will not be liable or otherwise responsible for any damages or loss arising from such circumstances.

3. How We Collect Personal Information

  • Uses or accesses our Site and/or completes one of our web forms (such as a contact, quote, or consultation request form).
  • Contacts us by phone, email, or any other means, or requests information from us.
  • Visits one of our locations, premises, or a job site.
  • Engages us to provide, or requests an estimate for, contracting services.
  • Provides us personal or business contact information via a business card or similar communication.
  • Completes a survey or otherwise provides us feedback.
  • Communicates with us via social media, third-party applications, or similar technologies.

In accordance with applicable law, we may collect personal information about you from third parties (such as referral sources, lead-generation partners, or public records), which we may combine with information we already hold about you in order to promote our legal or business interests. If you provide personal information about a third party, you expressly represent and warrant to ZUBR that you have the full right and lawful authority to provide it.

4. How We Use Your Information

ZUBR may use personal information for several business and administrative purposes, or to further our legal or other business interests. Generally, we use personal information for the following reasons:

  • Services and transactions. We may use your personal information to respond to inquiries, prepare estimates and proposals, schedule consultations and site visits, deliver contracting services you have requested, answer customer service requests, facilitate use of our Site, and process and collect payments. We also use personal information to send confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages. If you provide ZUBR with a telephone number as part of an inquiry, registration, or transaction, you consent and agree that ZUBR (or our service providers) may contact that number by any means (including SMS/text message) for service and transaction purposes.
  • Improving our business. We may use your personal information to perform business analyses or for other purposes that help us develop and improve the quality of our business, Site, and services, including conducting research and analysis and measuring the effectiveness of our advertising and marketing.
  • Marketing. In accordance with applicable laws, we may use your personal information to inform you of our services that may be of interest to you and to otherwise communicate with you about offerings, events, news, surveys, special offers, and related topics. You can opt out of email marketing at any time, free of charge, using the “unsubscribe” link in any marketing email you receive from us.
  • Security and enforcement. We may use personal information to detect, prevent, and respond to fraud, violations of our terms and conditions, violations of law, or other misuse of our Site, services, or facilities, and to administer and protect our business and Site (including system maintenance, support, reporting, and hosting). We may use personal information to protect the health and safety of our employees, contractors, clients, and others.
  • Legal and business interests. We may use personal information to promote, defend, or protect our legal, regulatory, or business interests, including enforcing contracts and other agreements.

5. Sharing Your Personal Information With Others

ZUBR does not sell, lease, or rent personal information on any individual, including minors, to a third party for profit or other valuable consideration, and we do not share your personal information with third parties for their own direct marketing purposes. We may, however, share your personal information with selected third parties solely to operate our business and provide the services you request, in accordance with applicable law, including as set forth below.

  • Service providers. We may share your personal information with companies we have contracted to provide services on our behalf, such as hosting our Site, processing payments, providing customer service, facilitating our marketing activities, or performing analyses to improve the quality and security of our business, Site, and services.
  • Subcontractors and project partners. In connection with delivering contracting services, we may share relevant personal information (such as project address and contact details) with subcontractors, suppliers, architects, engineers, inspectors, and similar parties as necessary to perform the work.
  • Payments. Payments may be processed using a third-party payment system. Any personal or financial information you provide to such a system is subject to that third party’s privacy policy and terms of use, and we recommend you review those policies before providing any personal or financial information.
  • Business restructuring. We may disclose information we maintain about you to the extent reasonably necessary to proceed with the negotiation or completion of a merger, acquisition, financing, divestiture, or sale of all or a portion of ZUBR’s assets.
  • Disclosure for other reasons. We may disclose personal information (i) if required by law, government order, or legal process; (ii) to protect and defend our rights or property; or (iii) in urgent circumstances, to protect the health and personal safety of any individual. We may also disclose your information upon your express consent.

6. Third-Party Links and Social Media Features

Our Site may include links to other websites, including those operated by unaffiliated third parties. Each such third-party website has its own privacy policies and practices, which may differ from ours; we urge you to read any privacy statement posted there carefully. ZUBR exercises no authority or control over these third parties and is not responsible for any information you submit at their websites or how it is used.

Our Site may also include social media features and widgets. These features may collect your IP address and which page you are visiting on our Site, and may set a cookie to enable the feature to function. Your interactions with these features are governed by the privacy policy of the company providing them.

7. Data Retention and Localization

The period during which ZUBR retains your personal information varies depending on the purpose for the processing. For example, we retain personal information needed to provide services, facilitate transactions you have requested, or engage in marketing activities, and for as long as necessary to defend our legal or business interests. In all other cases, we retain your personal information for as long as needed to fulfill the purposes outlined in this privacy policy.

ZUBR is based in the United States, and the personal information we collect and process is retained and stored in the United States. By continuing to provide us such information, you consent to your personal information being transferred to, and stored in, the United States.

8. Information Security

We are committed to protecting the security of your personal information and use a variety of security technologies and procedures to help protect it from unauthorized access, use, or disclosure. However, no information system can be fully secure, so we cannot guarantee the absolute security of your personal information. We are not responsible for the security of information you transmit to the Site over networks we do not control, including the Internet, and you provide any information at your own risk. Where we have given you (or you have chosen) a username and password, you are responsible for maintaining their security and confidentiality and must contact us immediately if you believe they have been compromised.

9. No Personal Information Collected From Children

Our Site is not directed at, nor intended for use by, children. We will not knowingly collect information from children under eighteen years of age. If you are under eighteen, you are prohibited from using our Site or providing us with personal information unless you have affirmative authorization from your parent or legal guardian.

10. Your Responsibilities

You agree to provide personal information to ZUBR only if such information is accurate, reliable, and relevant to our relationship, and only to the extent such disclosure does not violate any applicable data protection law or infringe upon any individual’s data privacy rights. If you provide ZUBR with any personal information about yourself or a third party, you expressly represent and warrant that you have the full right and authority to disclose it, that ZUBR can use it in accordance with this privacy policy, and that you are in compliance with the requirements set forth herein.

11. Cookies and Online Analytics

When you visit this Site, we employ certain cookies and similar technologies to collect information and enhance your experience. Cookies are files that store information about your visit to and use of the Site. Accepting nonessential cookies through your web browser is your personal choice; you can set your browser to disable them. However, if you choose not to accept cookies, some features of the Site may not function properly, and we may not be able to provide you with as tailored an experience.

We may use analytics services (such as Google Analytics) and advertising tools that use cookies and similar technologies to help us understand how visitors use our Site and to measure the effectiveness of our marketing. For information on cookies and behavioral advertising, see http://www.allaboutcookies.org. You may opt out of interest-based advertising from participating companies through the Digital Advertising Alliance at http://optout.aboutads.info and the Network Advertising Initiative at http://www.networkadvertising.org/choices.

12. Email Marketing and Opt-Out Requests

You have the right to opt out of receiving electronic direct marketing communications from us. All marketing emails you receive from us will include an “unsubscribe” option. We do not share personal information with third parties whom we have reason to believe would use such information for their own direct marketing purposes.

13. Text/SMS Message Consent and Opt-Out

You may, in your sole discretion, provide ZUBR with your mobile telephone number in order to receive text messages from us, such as messages related to your project, scheduling, or promotions. By providing your mobile number, you (i) represent that you are the owner of, and have authority to provide, that number, and (ii) consent to receive text messages from us at that number. Your consent to receive marketing text messages is not a condition of any purchase of goods or services. Standard text/SMS message and data rates may apply. You can opt out of further text marketing communications by texting STOP to the number used to contact you or by contacting us directly using the “Contact Us” section below.

No mobile information — including your mobile phone number and your consent to receive text messages — will be shared with or sold to any third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties, except for aggregators and service providers acting on our behalf strictly to transmit the text messages you have requested. This information will not be shared with any third parties for their marketing purposes under any circumstances.

14. California Consumer Privacy Act

Pursuant to the California Consumer Privacy Act of 2018, as amended (“CCPA”), certain California residents may have additional data privacy rights, including the right to be notified about what personal information is collected and the purposes for collecting it; the right to know and access the categories or specific pieces of personal information we have collected, used, or disclosed about them over the past twelve (12) months, and the categories of sources and business or commercial purposes involved; the right to request that we (and any applicable service provider) delete their personal information under certain circumstances; and the right not to be subject to discrimination for exercising their CCPA rights. ZUBR does not sell your personal information to third parties for profit or other valuable consideration.

If you (or an authorized agent on your behalf) make any request related to your personal information under the CCPA, ZUBR will verify your identity to the degree of certainty required under the law before addressing your request. We may require you to match two or more pieces of personal information we have previously collected before granting access to, or deleting, specific pieces or categories of personal information, and may require written documentation demonstrating that a third party is authorized to act as your agent.

15. Do Not Track Signals

Some web browsers may transmit “Do Not Track” signals to the websites with which the user communicates. Because of differences in how browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted. We currently do not, unless otherwise required by law, take action in response to these signals.
